BY USING THE APP, YOU (“USER/CUSTOMER”) ARE CONSENTING TO BE BOUND BY AND ARE BECOMING A PARTY TO THESE TERMS. IN ADDITION, ANY ONLINE ORDER FORM WHICH YOU SUBMIT VIA Jammed ReStore’s STANDARD ONLINE PROCESS AND WHICH IS ACCEPTED BY Jammed ReStore SHALL BE DEEMED TO BE MUTUALLY EXECUTED.
TO USE THIS MOBILE APPLICATION, YOU REPRESENT AND WARRANT THAT YOU ARE 18 YEARS OF AGE OR OLDER, HAVE FULL LEGAL AUTHORITY TO ENTER INTO THIS AGREEMENT, UNDER ALL APPLICABLE LAWS. IF THE TERMS OF THIS AGREEMENT ARE CONSIDERED AN OFFER, ACCEPTANCE IS EXPRESSLY LIMITED TO SUCH TERMS.

OVERVIEW
Jammed ReStore is a mobile-based recommerce platform that operates only in the Philippines. It allows users to buy and sell pre-loved items in a safe and user-friendly way. On Jammed ReStore’s platform, you can easily list used items, such as clothing, home appliances, or smartphones and many more, and find great deals of high-quality, gently-used products.
This Privacy Policy describes how Jammed ReStore (“we”, “our”, or “us) collects, uses, and protects your information when you use our application (“App) We are committed to ensuring the privacy and security of your personal data in accordance with the Data Privacy Act of 2012 (R.A No. 10173) and other applicable data protection laws in the Philippines.
By visiting or using the Jammed ReStore mobile application (“App”) and/or engaging with us—whether by browsing, creating an account, or purchasing a product—you are engaging in our “Service” and agree to be bound by this Privacy Policy, including any additional terms and conditions referenced herein or available via hyperlink.
This Privacy Policy applies to all users of the App, including, without limitation, browsers, vendors, customers, merchants, and contributors of content.

To use certain features of the App (such as ordering products or Services), we may require you to provide to our third party payment processor, certain financial information (like your bank account or credit card information) in order to facilitate the processing of payments. All financial information will be collected directly by third party payment processors according to their privacy policies.

Communications with Jammed ReStore and other users and customers. When you communicate with Jammed ReStore or use the App to communicate with other users and customers, we collect information about your communication and any information you choose to provide.

Providing this information is entirely optional and can be modified or removed at any time through your profile settings.

You may otherwise choose to provide us information when you fill in a form, conduct a search, update or add information to your Jammed ReStore account, respond to surveys, post to community forums, participate in promotions, or use other features of the Site. In these situations, Jammed ReStore will collect the requisite consent.
2. Information We Automatically Collect from Your Use of the App.
When you use the App, we automatically collect information, including personal information, about the services you use and how you use them. This information is necessary for the performance of a contract in which the data subject is a party and to allow us to comply with our legal obligations under the contract and more generally. Also, this information is necessary given our legitimate interest in being able to provide and improve the functionalities of the App.

Geo-location Information. When you use certain features of the App, we may collect information about your precise or approximate location as determined through data such as your IP address or mobile device's GPS to offer you an improved user experience. Most mobile devices allow you to control or disable the use of location services for applications in the device's settings menu. Jammed ReStore may also collect this information even when you are not
using the app if this connection is enabled through your settings or device permissions.

Usage Information. We collect information about your interactions with the App such as the pages or content you view, your searches for Products or Services, donation requests you have made, and other actions on the Site.

Log Data and Device Information. We automatically collect log data and device information when you access and use the App, even if you have not created a Jammed ReStore Account or logged in. That information includes, among other things: details about how you've used the App (including if you clicked on links to third party applications), IP address, access dates and times, hardware and software information, device information, device event information, unique identifiers, crash data, cookie data, and the pages you've viewed or engaged with before or after using the App.

DATA RETENTION

Your profile data will be retained for up to 2 years from your last interaction with the App.

Your data will exist on the platform as long as your account is active. Upon your request for account deletion, your account will be processed for deletion.

User data may be restored indefinitely but will not be accessed or viewed unless required for account restoration, by law enforcement, or other authoritative entities with valid reasons to access your information.
THIRD-PARTY LINKS
Certain content, products and services available via our App may include materials from third-parties. These services may have access to your information to perform their functions while adhering to best practices encryption and authentication methods to ensure data protection.

DATA DELETION
Users may request deletion of their account and associated date by contacting Jammed ReStore at customersupport@jammedrestore.app . Upon verification, Jammed ReStore will:

Deactivate user’s account.

Delete or anonymize user’s personal information from Jammed Restore’s active system.

Retain only the data legally required for the retention period outline above.

DATA DELETION FOR FACEBOOK LOGIN USERS
If you signed up for Jammed ReStore using Facebook Login and wish to delete your account and associated personal data, you may do so in the following ways:

In-app Deletion. Navigate to your account settings > Delete Account, and follow the on-screen instructions. This will permanently delete your user profile and related data from our platform.

Manual Request. If in-app deletion is not available or you prefer a manual process, please contact us at customersupport@jammedrestore.app with the subject line: “Facebook Data Deletion Request”. Include your Facebook-linked email address and user ID (if known). We will process your request within 7-14 business days, subject to applicable data retention obligation.
Note: Some transactional or legally required data may be retained for up to five (5) years in compliance with the Data Privacy Act of 2012, BIR, and AMLC regulations.

DISCLOSURE OF PERSONAL DATA FOR ORDER FULFILLMENT

Buyer Consent to Data Disclosure
By using the Jammed ReStore platform and placing an order, buyers expressly agree and consent to the disclosure of their full name, contact number, and delivery address to the seller or authorized logistics provider for the sole purpose of fulfilling and delivering their order. This information is shared strictly on a need-to-know basis, and only with parties directly involved in the processing and delivery of the buyer’s purchase.

2. Limitation of Use (for Sellers and Logistics Partners)

Sellers and logistics partners receiving this information agree to use it only for order fulfillment, and must not:

Store the information beyond what is necessary for the transaction

Use the information for marketing or solicitation

Share it with any other third party

Retain physical or digital copies once the transaction is completed
All sellers on the Jammed ReStore platform are required to adhere to these conditions. Violation may result in account suspension or legal action.
3. Seller Data Responsibility Agreement

By listing items and accepting orders on Jammed ReStore, sellers acknowledge and agree to handle buyer data responsibly and in accordance with the Philippine Data Privacy Act of 2012 (RA 10173). Sellers are considered "data processors" and are bound by the same legal and ethical obligations to protect user information.
4. Data Protection Commitment

Jammed ReStore is committed to protecting user data and complies with the Philippine Data Privacy Act of 2012 (RA 10173). We require all sellers and service providers to uphold data privacy standards and handle customer information responsibly.
5. Platform Safeguards

To prevent unauthorized access, we implement role-based access controls and limit the visibility of personal data to only those who are part of the transaction. All access and transfers are logged and monitored.
6. Your Rights as a Buyer

As a user, you may request to access, correct, or delete your personal information, or withdraw your consent at any time, subject to applicable laws and pending transaction obligations.
7. Reference in Terms & Conditions

By creating an account or placing an order through Jammed ReStore, you acknowledge that you have read and agree to our Terms & Conditions and Privacy Policy, including the disclosure of your personal information (name, contact number, and delivery address) to third parties directly involved in the fulfillment of your order.
COPYRIGHT AND TRADEMARK POLICY
All contents included in our App, such as text, graphics, logos, button icons, images, clips, digital downloads, data compilations, and software, is the property of Jammed ReStore, its Users and its content suppliers and protected by copyright laws.
All software used on this Mobile App is the property of the Jammed ReStore.
All other trademarks not owned by Jammed ReStore that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Jammed ReStore or its affiliates.
ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Privacy Policy shall not constitute a waiver of such right or provision.

These Privacy Policy and any policies or operating rules posted by us on this app, or in respect to the service constitutes the entire agreement and understanding between you and us and govern your use of the App or service superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Privacy Policy).
