BY USING THE APP, YOU (“USER/CUSTOMER”) ARE CONSENTING TO BE BOUND BY AND ARE BECOMING A PARTY TO THESE TERMS. IN ADDITION, ANY ONLINE ORDER FORM WHICH YOU SUBMIT VIA Jammed ReStore’s STANDARD ONLINE PROCESS AND WHICH IS ACCEPTED BY Jammed ReStore SHALL BE DEEMED TO BE MUTUALLY EXECUTED.

 

TO USE THIS MOBILE APPLICATION, YOU REPRESENT AND WARRANT THAT YOU ARE 18 YEARS OF AGE OR OLDER, HAVE FULL LEGAL AUTHORITY TO ENTER INTO THIS AGREEMENT, UNDER ALL APPLICABLE LAWS. IF THE TERMS OF THIS AGREEMENT ARE CONSIDERED AN OFFER, ACCEPTANCE IS EXPRESSLY LIMITED TO SUCH TERMS.

OVERVIEW

 

Jammed ReStore is a mobile-based recommerce platform that operates only in the Philippines. It allows users to buy and sell pre-loved items in a safe and user-friendly way. On Jammed ReStore’s platform, you can easily list used items, such as clothing, home appliances, or smartphones and many more, and find great deals of high-quality, gently- used products.

This mobile application is operated by Jammed ReStore. Throughout the site, the terms “we”, “us” and “our” refer to Jammed ReStore. Jammed ReStore offers this mobile application, including all information, tools and services available from this app to you, the user/customer, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

 

By accessing or using our application, including but not limited to account registration and/or the completion of any purchase transactions through the platform, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the platform, including, without limitation, individuals who browse the site, register an account, make purchases or sales, offer products or services, or contribute content in any form.

 

Please read these Terms of Service carefully before accessing or using our mobile application. By accessing or using any part of the app, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the mobile app or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

 

Any new features or tools which are added to the current mobile application shall also be subject to the Terms of Service. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our mobile app. It is your responsibility to check this page periodically for changes. Your continued use of or access to the app following the posting of any changes constitutes acceptance of those changes.

 

By using our services, you consent to the collection and disclosure of your personal information as described in our [Privacy Policy], including the sharing of your name, contact number, and delivery address with sellers or logistics partners for order fulfillment.

 

SECTION 1 - GENERAL CONDITIONS

 

Jammed ReStore reserves the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is encrypted during transfer over networks.

 

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the app through which the service is provided, without express written permission by us.

 

The headings used in this Terms of Service are included for convenience only and will not limit or otherwise affect these Terms.

 

SECTION 2 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

 

We are not responsible if information made available on this platform is not accurate, complete, or current. The material on this platform is provided for general informational purposes only and should not be relied upon or used as the sole basis for making decisions without consulting more accurate, complete, or timely sources of information.

 

While we strive to ensure that all listings, pricing, availability, and platform-related content are accurate and up to date, we do not guarantee the accuracy, reliability, or completeness of any content submitted by users, including but not limited to sellers' product descriptions, images, prices, item conditions, and availability.

 

We also do not verify the truthfulness or accuracy of user-generated content such as reviews, ratings, or feedback. These reflect individual opinions and do not represent the views or warranties of Jammed ReStore.

 

 

In the event of a pricing error, mislabeling, or other inaccuracies, we reserve the right to correct such errors and to cancel or refuse any order placed based on incorrect information, whether or not the order has been confirmed or payment has been processed.

 

Additionally, our platform may include services or data from third-party providers such as logistics partners, payment gateways, and other integrated tools. While we work with reputable providers, we do not warrant the accuracy, reliability, or availability of any third-party services or their content. Any issues arising from third-party services are subject to their respective terms and policies.

 

We reserve the right to modify the contents of the platform at any time but are under no obligation to update any information. You agree that it is your responsibility to monitor changes to the platform and to verify critical information before relying on it.

 

SECTION 3 - MODIFICATIONS TO THE SERVICE AND PRICES

 

Prices for our services are subject to change without notice. Jammed ReStore reserves the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

 

Jammed ReStore shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

 

 

SECTION 4 - PROPERTIES OR SERVICES

 

Certain services may be available exclusively online through the mobile application. We reserve the right, but are not obligated, to limit the sales of our services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of services that we offer. All descriptions of service pricing are subject to change at any time without notice, at the sole discretion of us.

 

We do not warrant that the quality of any services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

 

 

SECTION 5 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

 

You agree to provide current, complete, and accurate account and billing information for all transactions made through the Jammed ReStore mobile application. You are responsible for promptly updating your account details, including your email address, payment method, and any other relevant information, to ensure successful processing of transactions and proper communication from us.

 

Failure to maintain accurate information may result in delays, failed transactions, or suspension of your account.

Certain content, products and services available via our Service may include materials from third-parties.

We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.

 

We are not liable for any harm or damages related to the purchase or use of services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third- party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

 

 

SECTION 7 – YOUR PERSONAL INFORMATION AND ACCOUNT

 

Your submission of personal information through the app is governed by our Privacy Policy.

 

For certain uses of this mobile application, Jammed ReStore may require you to provide information about yourself (such as identification or contact information) or to create a user account. You agree that any such information and any information that you provide in connection with your account will be correct, complete, up to date, and shall reflect and match government issued identifications. You will be responsible for all activities that occur under your Account and therefore agree to keep your password confidential. You agree to notify us immediately of any unauthorized use of your account or if you believe that your password is no longer confidential.

We reserve the right to require you to alter your username and/or password if we believe that your Account is no longer secure. You will not: (a) provide any false information as part of your Account information or in connection with the Site; (b) create an Account for anyone other than yourself; (c) create or use more than one Account at any given time; (d) transfer your Account to anyone else; (e) permit others to use your Account; or (f) use or access other persons' Accounts.

 

SECTION 8 - ERRORS, INACCURACIES AND OMISSIONS

 

Occasionally there may be information on our mobile app or in the Service that contains typographical errors, inaccuracies or omissions that may relate to service descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related app is inaccurate at any time without prior notice (including after you have submitted your order).

 

We undertake no obligation to update, amend or clarify information in the Service or on any related app, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related app, should be taken to indicate that all information in the Service or on any related app has been modified or updated.

 

SECTION 9 - PROHIBITED USES

 

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts;

(c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related app, other apps, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related app, other apps, or the Internet. We reserve the right to terminate your use of the mobile app or any related app for violating any of the prohibited uses.

 

 

SECTION 10 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

 

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

 

You agree that from time to time we may remove the mobile app or service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the mobile app and its service is at your sole risk. The service delivered to you through the app are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantable quality, fitness for a particular purpose, title, and non- infringement.

 

In no case shall Jammed ReStore, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

 

SECTION 11 - INDEMNIFICATION

 

You agree to indemnify, defend and hold harmless Jammed ReStore, its affiliates, governing board, officers, agents, employees, partners, and suppliers from any liability, loss, claim, demand, costs and expenses (including reasonable attorneys' fees) related to:

  • your use of the App;

  • any breach or inaccuracy of any representation or warranty made under these Terms;

  • your violation of these Terms;

  • your violation of applicable laws or any rights of third parties; or

  • your posting of User Content to the App.

 

SECTION 12 – SEVERABILITY

 

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

 

SECTION 13 – NOTE TO INTERNATIONAL VISITORS

 

By visiting our mobile app and using any of the services available through the app (the "services"), your personal information will be processed in accordance with our privacy policy ("privacy policy"). Your personal information may be processed in the Philippines where this app is operated. By using the app or submitting personal information through the services, you are expressly consenting to such processes. To the extent you provide personal information about a named person or entity that is not a current user of our services, you represent that you have that person or entity's consent to do so.

 

SECTION 14 – APP CONDUCT

 

When using the App, you agree to comply with the following guidelines:

  • you may not post or transmit information, data, text, software, graphics, sound, photographs, video, messages, or other content (collectively, "Content") that is unlawful, harassing, inaccurate, libelous, defamatory, obscene, fraudulent, harmful, threatening, abusive, hateful, or is otherwise determined to be objectionable by us;

  • you may not interfere with other users' use of the App;

  • you will not post or upload any virus, time bomb, worm, corrupted file, or other software routine capable of disrupting, disabling, harming the operation of, or providing unauthorized access, to the App;

  • you will comply with all of these Terms and any applicable laws or regulations (including any laws regarding the export of data or software to and from the Philippines or other relevant countries);

  • you may not impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;

  • you may not post or transmit Content that you do not have a right to post or transmit under any law or under contractual or fiduciary relationships (such as inside information, confidential information, etc.); and

  • you may not use the Site to solicit, collect or store personal data or passwords of other users.

 

SECTION 15 - SUBMISSION OF CONTENT

You grant to Jammed ReStore a world-wide, royalty-free, perpetual, irrevocable, transferable, non-exclusive and fully sub licensable right and license to use, reproduce, modify, adapt, publish, translate, prepare derivative works of, distribute, perform and display any and all Content (in whole or part) that you post or submit to the App ("User Content"), and to incorporate the User Content in other works, in any form, media, or

technology now known or later developed. You represent and warrant that:

(a) you have the right to grant the foregoing license and to post and submit the User Content; and (b) the User Content will not infringe, misappropriate, or violate any third party rights (including any intellectual property rights). You are solely responsible for your User Content. Jammed ReStore reserves the right in its sole discretion to delete or leave unchanged any Content submitted to or appearing on the App.

 

 

SECTION 16 - OWNERSHIP OF CONTENT AND INTELLECTUAL PROPERTY RIGHTS

Jammed ReStore and its licensors own the App and all Content therein (other than your User Content) ("Site Content") and all worldwide intellectual property rights relating to the foregoing. Except as expressly authorized by Jammed ReStore, you may not copy, distribute, sell, lease, perform, display, sublicense, modify or prepare derivative works of the App or Content, in whole or in part. Jammed ReStore reserves all rights not expressly granted to you under these Terms. Any use of the Site not expressly permitted by these Terms will be deemed a breach of these Terms and may violate copyright, trademark, and other laws.

Jammed ReStore will treat any feedback or suggestions you provide to it as non-confidential and non-proprietary. You grant Jammed ReStore the right to use any feedback or suggestions you provide in any manner and for any purpose without any obligation to compensate you.

SECTION 17 - TERMINATION

 

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

 

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

 

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

 

SECTION 18 – COMMUNITY AND SELLING GUIDELINES

 

By accessing or using the Jammed ReStore platform, all users agree to comply with our Community Guidelines and Selling Guidelines, which outline acceptable conduct, prohibited items, listing standards, and other platform policies. These guidelines form an integral part of these Terms and are legally binding on all users.

 

Failure to adhere to these guidelines may result in corrective actions, including but not limited to: content removal, account warnings, suspension, or permanent termination of access—at the sole discretion of Jammed ReStore.

SECTION 19 - REFUND POLICY

 

All users of Jammed ReStore, including Buyers and Sellers, are required to comply with our Cancellation, Return, and Refund Policy, which sets forth the conditions under which transactions may be cancelled, items returned, and refunds issued.

 

Buyers are responsible for reviewing item descriptions, seller ratings, and other relevant details prior to making a purchase. Sellers are expected to provide accurate product information and uphold commitments regarding item quality and fulfillment.

 

Jammed ReStore reserves the right to review and mediate disputes between Buyers and Sellers and, where applicable, to issue refunds in accordance with our established refund guidelines.

Failure to comply with our policies may result in cancellation of transactions, denial of returns or refunds, and potential suspension or restriction of user accounts.

 

SECTION 20 - ENTIRE AGREEMENT

 

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

 

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

 

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Philippines.

Your continued use of or access to our app or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

 

SECTION 23 - ELECTRONIC COMMUNICATIONS

For contractual purposes, you (a) consent to receive communications from Jammed ReStore in an electronic form (whether Jammed ReStore posts notices on the App or communicates with you via email); and (b) agree that all terms and conditions, agreements, notices, disclosures, and other communications that Jammed ReStore provides to you electronically satisfy any legal requirement that such communications would satisfy if it were be in a hardcopy writing. The foregoing does not affect your non- waivable rights. Any notices to you by Jammed ReStore may be made by either email or regular mail.
